Bunmor CC Trading as The Big Purple Truck Reg. no. 2006/152460/23 is herein after referred to as ‘the Big Purple Truck’ and the person or persons who have signed the booking form is herein after referred to as the ‘Client’.  Upon signature the client agrees to be bound by these booking conditions and any contract between the client and the Big Purple Truck is subject to and shall be governed and construed according to South African law.

  1. Booking & Payment
    1. A signed and completed booking form must be sent to The Big Purple Truck or its agent together with a non-refundable deposit of 25% of the tour price.  The balance of the tour fare is to be paid 28 working days prior to the date of departure.
    2. The Big Purple Truck will not accept any booking where the booking form has not been signed or is incomplete in any way.  Once the Big Purple Truck is in receipt of a signed booking form, plus 25% deposit, a confirmation will be issued.  It is only at this time the booking will be deemed for acceptance.  The Big Purple Truck reserves the right to decline any booking without outlining its reasons therefore.
    3. All tour prices and services are correct at the time of printing and The Big Purple Truck reserves the right to change all prices, services and departures without prior notice.  However once a booking has been made and the full tour cost paid, The Big Purple Truck will not increase the price.
    4. If the full amount is not paid by 28 working days prior to departure, the Big Purple Truck reserves the right to treat the booking as cancelled and the deposit shall be forfeited.
    5. Clients booking within 28 days of tour departure are required to pay the full amount immediately to secure the seat.
  1. Cancellations or Changes to bookings
    1. Cancellation of any booking must be received in writing and acknowledged by The Big Purple Truck.
    2. In the event of cancellation the following cancellation fees will be payable by the client:
      Notification is received 28 days or more before departure, loss of 25% deposit
      28-21 working days, loss of 40% of tour cost
      15-21 working days, loss of 60% of tour cost
      8-14 working days, loss of 80% of tour cost
      7-0 working days, loss of 100% of tour cost.
      If you fail to join a tour, join after its departure, or leave it prior to its completion for any reason, is not entitled to any reimbursement whatsoever from the Big Purple Truck, or entitled to claim any added expenses.
    1. Changes made by you:  If you need to change your reservation for whatever reason, the Big Purple Truck will make every effort to assist you.  You may move your reservation to another date, subject to availability and agreement with our reservation office.  Any subsequent cancellation fee will be based on the date of original travelling date.  Should we not be able to help you with alternative dates, the normal cancellation fees will apply.
    2. Tours are subject to a minimum of 5 clients.  If that number is not obtained, the Big Purple Truck reserves the right to cancel the tour.  A full refund would then be payable to all booked clients.
    3. The Big Purple Truck reserves the right to change or cancel any tour, without prior notice where this is unavoidable, although every effort will be made to operate tours as advertised.  However in the instance of cancellation of a tour the Big Purple Truck agrees to refund all monies already paid by the client.  This shall be the Big Purple Truck’s sole responsibility to the client and no claim for any damages, howsoever arising, shall accrue against the Big Purple Truck.
  1. Force Majeure
    1. Unforeseen circumstances including, but not limited to weather, road conditions, war, mechanical breakdown, riots and other reasons beyond the control of the Big Purple Truck may cause delays or alterations to the tour.  In the event of the aforementioned occurring, the Big Purple Truck shall not be held liable in any way for any resulting costs of these delays or alterations.
  1. Local Payment
    1. The local payment is to be paid to the guide on the day of departure in US$ cash only.  No traveller’s cheques or other currencies will be accepted.
  1. Passport, Visas and other Travel Documents.
    1. The client is responsible for obtaining all travel documents, passport, visas and health certificates are ensuring all such documentation is valid.
  1. Insurance
    1. Comprehensive travel insurance covering cancellation, curtailment, medical, emergency travel and personal accident is mandatory on all tours.  Insurance for loss of baggage, money and personal items is also recommended.  It is the client’s responsibility to ensure they have this insurance in place and the required paperwork to prove such before embarking on the tour.
    2. Any resulting consequence of not having this paperwork is the sole responsibility of the client.
  1. Baggage
    1. All personal effects and baggage are at all times the client’s responsibility and the Big Purple Truck will not accept any liability for any loss or damage to baggage or personal effects.
    2. Clients are entitled to one bag of not more than 20kg and a daypack.  Should a client require a larger baggage allowance, this can be arranged at the discretion of the Big Purple Truck.
  1. Health
    1. It is the responsibility of the client to consult a health professional with respect to the recommended and compulsory vaccinations and health precautions.  Any pre-existing medical conditions must be declared at the time of booking and the client must make arrangements for the provision of drugs or other treatment that may be required during the tour.
    2. Clients are aware of the proposed itinerary and that the tour requires a measure of physical fitness and health and that they are medically fit to embark on the tour.
  1. Exclusion of Liability
    1. Client bookings are accepted on the understanding by the client that all tours are of an adventurous nature and involve an element of personal risk that is an inherent part of travel in Africa.
    2. Clients undertake all tours entirely at their own risk and while the Big Purple Truck takes every precaution to ensure the safety of the clients, no responsibility can be accepted for any death, injury or loss that might occur to such clients, sustained from any cause whatsoever.
    3. The client and his/her dependants, heirs, executors, administrators or assigns, hereby indemnify and hold blameless the Big Purple Truck, its members, employees, representatives and agents from any claims of whatsoever nature and from any liability for delay, loss, damage, injury, illness or death arising from any cause whatsoever out of events related to or occurring during a tour.
    4. The client agrees to strictly abide by the laws and regulations of each country that we visit.
    5. Clients are responsible for checking in on time and are responsible for reconfirming flight times.  The Big Purple Truck cannot be held responsible for delays caused by airline flight alterations, cancellations or delays.
    6. When you book activities or excursions not operated by the Big Purple Truck (whether recommended by the company or not), the Big Purple Truck will have no liability for problems arising from the activity or excursion and any claim will be against the relevant local operator (e.g. bungee jumping, abseiling etc).
  1. Authority on Tour
    1. The decisions of the Big Purple Truck’s guide/driver on tour shall at all times be final and binding.
    2. The client must at all times comply with the laws, customs and foreign exchange regulations of all countries visited.
    3. Should any client be in contravention of the above or the client is a nuisance to the group the driver/guide may order the client to leave the tour without any claim to a refund.  The client shall be obliged to make their way home at their own expense.
  1. Photography
    1. The Big Purple Truck reserves the right to make use, without giving any further notice, of any photograph or film produced by The Big Purple Truck without payment or permission.
    • Complaints
    • If the client has a complaint whilst on tour they must bring it to the guide’s attention so that it can be dealt with.  If the matter is not resolved whilst on tour, the clients must write to the Big Purple Truck within 30 days of completion of the tour.  The Big Purple Truck will not entertain complaints of loss of enjoyment where full land arrangements have been provided.
